Please read these Terms and Conditions carefully and in their entirety before using beyouthentic.com or purchasing any product or service offered by YOU-thentic Elevation Coaching and Consulting LLC.

These Terms and Conditions contain an Arbitration Clause and require you to dispute or resolve any claim through binding arbitration. By agreeing to these Terms and Conditions, you voluntarily waive your right to a jury trial. Please refer to Section 13 for the full Arbitration Clause.

1.Β DEFINITIONS

"Company", "We", "Our", or "Us" means YOU-thentic Elevation Coaching and Consulting LLC and its website, beyouthentic.com.

"Content" means any and all written, visual, video, or audio information contained on the Site, including but not limited to emails, newsletters, blog posts, graphics, documents, templates, downloadable materials, and any product or service offered by the Company.

"Products and Services" means beyouthentic.com and all associated pages, landing pages, and sub-pages, along with the following offerings: The Burnout Risk Snapshot (free assessment), The Sustainability Gap (digital guide), The Sustainable Behavioral Health Provider Intensive (8-week coaching program, individual and group formats), Practice Consulting and Chart Auditing services, and any additional products or services offered by the Company now or in the future.

"Personal Information" means information that can be used to identify, contact, or locate a person, including but not limited to your name, email address, telephone number, and payment information.

"You", "Your", or "Client" means the user, customer, or purchaser of the Site, Products, and Services.

2. CONSENT

By using the Site and/or making any purchase, you implicitly and voluntarily agree to act in accordance with and abide by these Terms and Conditions.

By using the Site and/or making any purchase, you represent and warrant that you are at least 18 years old. Any use of or access to the Site by anyone under the age of 18 is unauthorized and in direct violation of these Terms and Conditions.

3. IMPORTANT DISCLAIMER β€” COACHING IS NOT THERAPY

YOU-thentic Elevation Coaching and Consulting LLC is a professional coaching and consulting business. Anna Gonzalez-Hardy holds licensure as a Licensed Professional Counselor (LPC) and Licensed Mental Health Counselor (LMHC). Her credentials are referenced for professional credibility purposes only.

All services offered by YOU-thentic Elevation Coaching and Consulting LLC are professional coaching and consulting services. They are NOT therapy, counseling, psychotherapy, mental health treatment, or clinical services of any kind. No client-therapist relationship is formed through any interaction with this Site or through the purchase or use of any Product or Service.

If you are experiencing a mental health crisis, symptoms of a mental health condition, or believe you need clinical mental health services, please contact a licensed mental health professional, your physician, or a crisis service in your area.

Coaching is not a substitute for therapy, medical treatment, psychiatric care, or legal advice. By using this Site or purchasing any Product or Service, you acknowledge and agree that you understand the distinction between coaching and therapy and that you are not seeking clinical mental health services from YOU-thentic Elevation Coaching and Consulting LLC.

4. SCOPE OF SERVICES

The following is a brief description of the Products and Services offered by the Company:

The Burnout Risk Snapshot β€” A free self-assessment tool designed to help licensed behavioral health providers identify their burnout risk level. Results are for informational and self-reflective purposes only and do not constitute a clinical assessment, diagnosis, or treatment recommendation.

The Sustainability Gap β€” A paid digital coaching guide ($37) designed to help behavioral health providers understand and address professional burnout through a coaching framework. This is a downloadable digital product.

The Sustainable Behavioral Health Provider Intensive β€” An 8-week professional coaching program available in individual and group formats. This program is designed for licensed behavioral health professionals including but not limited to Licensed Professional Counselors (LPCs), Licensed Mental Health Counselors (LMHCs), Licensed Clinical Social Workers (LCSWs), psychologists, psychiatrists, psychiatric nurses, residents, and provisionally licensed clinicians with at least 2 years of post-graduate experience.

This program is a professional coaching program. It is NOT therapy, psychotherapy, or clinical mental health treatment. It is also NOT clinical supervision and is NOT a substitute for clinical supervision as required by your licensing board or regulatory authority. Participation in this program does not fulfill any supervision hours, continuing education requirements, or licensing obligations of any kind.

Practice Consulting and Chart Auditing β€” Custom consulting services for aspiring and established solo and group behavioral health practices with fewer than 10 clinical providers. Services may include operational consulting, sustainability coaching, and chart auditing for documentation compliance review. These services are informational and advisory in nature and do not constitute legal, accounting, or regulatory advice.

5. SITE RULES

By using the Site and/or making any purchase, you agree NOT to:

  • Abuse, harass, or threaten any person through or on the Site.
  • Post or transmit obscene, offensive, defamatory, or abusive content.
  • Use the Site in any way that violates any applicable law.
  • Copy, download, share, or distribute our intellectual property in any way that infringes our rights.
  • Share your login credentials or access with any person who has NOT purchased a Product or Service.
  • Represent our Content as your own or claim any association with the Company without written permission.
  • Record, capture, screenshot, or otherwise reproduce any live session, group session, individual session, or recorded program content in any format, including but not limited to audio recording, video recording, or screen capture, without prior written permission from the Company.
  • Download, copy, or save any video, audio, or recorded content provided as part of any program or service, except where expressly permitted by the Company in writing.

6. PROHIBITION ON AI TOOLS AND UNAUTHORIZED RECORDING DURING SESSIONS

To protect the privacy, confidentiality, and safety of all participants, the following are strictly prohibited during any live individual session, group session, or program-related interaction with YOU-thentic Elevation Coaching and Consulting LLC:

  • The use of any artificial intelligence notetaking, transcription, or recording tool, including but not limited to Otter.ai, Fireflies, Zoom AI Companion, Google Meet AI, or any similar tool, without prior explicit written consent from the Company.
  • The use of any third-party application, software, plugin, or device that records, transcribes, summarizes, or otherwise captures the content of any session without prior explicit written consent from the Company.
  • The recording of any session β€” live or recorded β€” by any means, including audio, video, or screen capture, without prior explicit written consent from the Company.
  • The downloading, saving, copying, or distribution of any recorded content provided as part of any program or service.

The Company reserves the right to immediately terminate a session and/or remove a participant from a program without refund if any of the above prohibitions are violated.

Participants who require notetaking accommodations due to a disability or other documented need should contact the Company at [email protected] prior to enrollment to discuss appropriate accommodations.

7. INTELLECTUAL PROPERTY

The Site and all of its Content are the intellectual property of YOU-thentic Elevation Coaching and Consulting LLC and are protected by United States copyright and trademark laws. All rights are reserved.

You may NOT reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or otherwise exploit any Content from this Site without prior written permission from the Company. This includes but is not limited to all coaching materials, program content, digital guides, assessment tools, frameworks, worksheets, templates, graphics, written content, and any other materials provided through the Site or through any Product or Service.

As a purchaser or participant, you are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for your own personal and professional development purposes. This license does not permit you to share, reproduce, or distribute any Content with any other person or entity, whether for compensation or otherwise.

Any unauthorized use of the Company's intellectual property will be pursued to the fullest extent permitted by law.

By submitting any content to the Company via contact form, email, or social media, you represent that you are the lawful owner of that content and grant the Company a license to use it for legitimate business purposes.

8. REFUND POLICY

The Burnout Risk Snapshot (Free) β€” No purchase required. No refund applicable.

The Sustainability Gap (Digital Guide, $37) β€” All sales are final. Due to the downloadable digital nature of this product, no refunds will be issued once the product has been delivered or accessed. Please review the product description carefully before purchasing.

The Sustainable Behavioral Health Provider Intensive (8-Week Coaching Program) β€” All sales are final. No refunds will be issued once enrollment is confirmed, regardless of attendance, participation, or program completion. By enrolling, you acknowledge and agree to this policy.

Practice Consulting and Chart Auditing Services β€” A non-refundable deposit is required to reserve consulting services. The deposit amount will be specified in your custom invoice and will be applied toward your total service cost. The remaining balance is due as specified in your invoice. No refunds will be issued on deposits or completed services.

No chargebacks: The Client will not, under any circumstances, issue or threaten to issue any chargebacks for any Product or Service. In the event of a chargeback, the Company reserves the right to report the matter to credit bureaus as a delinquent account.

10. NO CUARANTEES OR WARRANTIES

The Company does not offer any warranties, guarantees, or representations of any kind regarding the Site, Products, or Services. All Products and Services are offered AS IS without warranties of any kind, either express or implied, to the extent permitted by law.

Results from participation in any coaching program, use of any digital product, or engagement with any consulting service will vary from person to person. Individual outcomes depend on a wide range of factors including but not limited to personal circumstances, professional background, level of engagement, implementation of coaching concepts, and individual effort. No specific outcome, result, career change, professional improvement, increase in wages or compensation, change in job title or position, promotion, or change in employment status is guaranteed.

The decisions you make as a result of coaching β€” including but not limited to conversations with employers, requests for raises or promotions, changes in employment, or changes in practice structure β€” are made at your sole discretion and are your sole responsibility. YOU-thentic Elevation Coaching and Consulting LLC is not liable for any outcome, consequence, or impact resulting from decisions you make during or after participation in any Product or Service.

Any testimonials, examples, or results shared on this Site are illustrative only and are not guarantees that you will experience the same results. Each client's circumstances are unique.

11. LIMITATION OF LIABILITY

YOU-thentic Elevation Coaching and Consulting LLC is not responsible or liable for any damages β€” direct, indirect, special, exemplary, or consequential β€” arising from your use of, purchase of, or participation in any Product or Service. You assume full responsibility for how you implement or act upon any information provided through the Site, Products, or Services.

12. RELEASE AND INDEMNIFICATION

By using the Site or purchasing any Product or Service, you agree to release, defend, indemnify, and hold harmless YOU-thentic Elevation Coaching and Consulting LLC, its owners, employees, agents, contractors, and affiliates from any and all claims, suits, actions, liabilities, damages, and costs arising out of your use of the Site, your purchase of any Product or Service, or your breach of these Terms and Conditions.

13. ARBITRATION CLAUSE

If any dispute arises out of your use of the Site or purchase of any Product or Service, please contact us first at [email protected].

If we are unable to resolve the dispute amicably, you agree that the dispute shall be submitted to binding arbitration with the American Arbitration Association (AAA) before a mutually agreed-upon arbitrator, in accordance with AAA rules. Any arbitration hearing shall be held within 100 miles of Norfolk, Virginia.

By agreeing to these Terms and Conditions, you waive your right to a jury trial. The only award that may be issued is a refund of any amount paid to the Company for the applicable Product or Service. You may not seek additional, consequential, or punitive damages.

Any judgment entered by the arbitrator will be binding and may be entered in a court of competent jurisdiction in the State of Virginia.

14. GOVERNING LAW

These Terms and Conditions shall be governed by the laws of the Commonwealth of Virginia. Any action arising out of these Terms and Conditions shall be brought in a federal or state court located within the Commonwealth of Virginia.

15. LINKS TO THIRD-PARTY WEBSITES

The Site may contain links to third-party websites. The Company is not responsible for the content, privacy practices, or terms of any third-party website. You access third-party websites at your own risk.

16. MODIFICATION OF THESE TERMS

The Company reserves the right to modify these Terms and Conditions at any time without prior notice. The updated date at the top of this page will reflect any changes. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms and Conditions.

17. TERMINATION

The Company reserves the right to terminate your access to the Site, Products, or Services at its sole discretion if you violate any of these Terms and Conditions.

18. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT
